TERMS OF SALE & PLACING A BID

1) REGISTRATION FEE: A refundable registration fee of One Thousand US Dollars (1000) is required to register to obtain a bidder ID. Contact the selling broker to obtain a bidder ID. Credit cards are accepted. The registration fee is credited to the purchase price at time of closing. The registration fee is refunded in the event the bidder is unsuccessful. The registration fee is forfeited in the event that a successful bidder defaults.

2) CONDITION: The Aircraft is purchased in an "Airworthy" condition returned to service as determined by a technical pre-buy inspection to be conducted at a factory approved facility selected by the Seller. Only “Airworthy” discrepancies required to return the Aircraft to service shall be repaired. No cosmetic discrepancies shall be repaired. Any specifications or equipment lists provided are intended as introductory information only. Seller does not guarantee the accuracy of any information provided. We encourage and recommend any potential bidder to conduct a preliminary visual inspection and logbook review of the aircraft at the seller’s facility, prior to the end of the auction process. The “sole discretion” aspect of this transaction ends with the auction. No opportunity to reject the Aircraft is allowed after the auction is over. Do not bid unless you plan to purchase.

3) SELECTION OF THE WINNER: The winner of the auction will be the highest bidder at the price they bid. In the event that the highest bidder defaults on the purchase of the Aircraft (by not posting the Deposit or entering into the definitive Aircraft Sales Agreement as defined below), then the 2nd highest bidder shall be declared the winner at the price the 2nd highest bidder had bid. In the event that the 2nd highest bidder defaults on the purchase of the Aircraft, then the 3rd highest bidder shall be declared the winner at the price they bid. In other words, bid only what you are willing to pay and do not bid unless you are prepared to pay for and close this transaction.

4) DEPOSIT: The winner of this auction must tender a non-refundable One Hundred Thousand US Dollar (100,000) deposit at Insured Aircraft Title Service within 2 business days or the registration fee (1000) is forfeited and all winners rights shall expire. The deposit is considered non-refundable subject only to sellers delivery of the aircraft in airworthy condition. The deposit is refundable in the event that the seller defaults.

5) CONTRACT: The winner and Seller shall ratify a definitive Aircraft Sales Agreement drafted by the Seller in accordance with these terms no later than two (2) business days after notification of being the winner or the registration fee (1000) is forfeited and all winners rights shall expire.

6) TECHNICAL INSPECTION: The inspection facility shall be approved by the FAA and the aircraft's manufacturer and selected by the seller

7) CLOSING: The winner shall remit the full balance of the purchase price and accept delivery of the aircraft no later than three (3) business days after sellers notice that the aircraft is ready for delivery. No financing is provided

8) WARRANTIES: Other than Seller’s warranty of good title, there are no warranties of condition whatsoever subsequent to closing. At time of closing, the sale is final in “AS-IS” and “With all faults” condition.

9) REMOVAL FROM THE MARKET: Seller reserves the right to cancel this auction and / or withdraw the aircraft from the market at anytime.

8) RELEASE: By use of this system, Bidder releases OMNI INTERNATIONAL JET TRADING from a any liability whatsoever related to this transaction over and above bidders registration fee. By placing a bid you are making a contract between you and the seller. Once you place a bid, you may not retract it. In some states, it is illegal to win an auction and not purchase the item.
